Privacy and Data protection policy – Connect Solutions AG

This data protection policy applies to Connect Solutions AG, Zurich Switzerland a company duly established under the laws of Switzerland (“Connect”, or “we”). The policy shall govern the collection, use and disclosure of personal data submitted to Connect, and shall also explain Connect’s collection and handling of personal data of individuals in compliance with the requirements of the Swiss FADP requirements (Federal Act on Data Protection of 19 June 1992). The term “personal data” shall within this policy have the meaning as described to it in the FADP.

As a general statement please note, that Connect will only then collect, use or disclosepersonal data for reasonable business purposes if there is either a consent or a deemedconsent from the individual and information on such purposes have been disclosed. Connect may also collect, use or disclose personal data if required or authorised to do so under the applicable laws and regulations.

Privacy and Data Protection Policy

Collection of Personal Data

Connect collects personal data from customers, partners, business contacts, contractors, personnel and other individuals. Such personal data may be provided to it in different forms (in email messages, telephone conversations, through the Connect websites forms filled out by customers, face to face meetings, or provided by third parties. If a customer, prospect or individual will contact us, we may keep a record of that contact.

Connect collects the personal data when there is a necessity for business purposes or when necessary to meet the purposes for which the information had been submitted.

We will only collect, use, hold, communicate, process and/or disclose such personal data, in accordance with this policy. In case that you should be acting as an intermediary or otherwise on behalf of a third party or supply Connect with information related to a third party (such as an employee or colleague etc.), you undertake that you are an authorised representative or agent of such third party and have obtained all necessary consents from such third party to the collection, use, disclosure and processing by us of their personal data. Because Connect will be collecting the third party’s data from you, you covenant to make the third party (such as employee, customer etc.) aware of all matters listed in this policy in an appropriate way (for example by referring them to our website or by distributing a copy of our Policy).

Use of Personal Data

The main purpose for which Connect collects, holds and uses personal data are:

to provide our services;

to respond to an individual’s request; to maintain contact with customers, prospect and clients;

to keep customers and other contacts informed of the services that we are offering and industry developments that may be of interest to them, and to notify them of service offerings etc.;

for general management and reporting purposes, such as invoicing and account management;

for recruitment purposes;

for purposes related to the employment of our staff and providing internal services to them; and also

for other purposes related to the Connect business.

If an individual or entity chooses not to provide us with personal information, we may be unable to do such things.

Should you decide to unsubscribe from a Connect registration or mailing lists, or just elect not to receive further marketing information from the aforesaid company, you can either contact our Data Protection Officer,

or if you had been contacted by email, to use the unsubscribe function in that email to notify us (opt out). Please allow us a 30 day period for your request to be processed.

Disclosure of Personal Data to Third Parties and/or Cross Border Transfer

Connect does not disclose personal data to third parties except as listed hereinafter:

• when required by law

• when Connect has your consent or deemed consent

• or where Connect has engaged the third party such as subcontractors or data intermediaries specifically to assist with its activities. In such cases, any third parties engaged by Connect will be contractually bound to keep any and all information strictly confidential.

As part of an international network of companies belonging to the Connect group, Connect exchanges information, including personal information, between group companies. As a result, we may transfer personal information outside Switzerland to countries whose privacy laws do not provide the same level of protection as Switzerland’s. Connect and other companies belonging to the Connect group with which information are exchange may also use overseas facilities or contractors to process or back-up information or to provide certain services to them. As a result, Connect or another Connect group company may transfer your personal information to overseas facilities or contractors for these purposes.

However, any such transfer of information does not change Connect’s commitments to safeguard its privacy and the information remains subject to existing confidentiality obligations. Any service providers (inclusive any companies belonging to the Connect group) are strictly required to adhere to these privacy guidelines and not to keep, use or disclose personal information provided to them for any unauthorised purposes.

Any transfers of personal data to a territory outside of Switzerland will be in accordance with the FADP so as to ensure a standard of protection to personal data so transferred that is comparable to the protection under the FADP. Connect will ensure that the applicable laws and regulations are complied with, for example by concluding agreements that ensure that recipients of your data maintain an appropriate level of data protection.

Privacy on Connect Websites and Connect Applications

This policy also applies to any personal information we collect via our websites, including www.connectsolutions.ch, and applications including mobile applications. In addition to personal information that you provide to us directly (such as making a request or completing a registration form), Connect may also collect personal information from customers, prospects and other interested parties via its applications and websites.

Cookies are small text files that are placed on your computer by the websites that you visit.

They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site. The use of cookies has become a standard for most websites. If you are uncomfortable with the use of cookies, you can manage and control them through your browser (including removing cookies by deleting them from your cache) when leaving the website. In most cases, a visitor may refuse a cookie and still fully navigate the Connect.com websites, however other functionalities in the site may be impaired.

In order to properly manage our websites and applications, we may log certain statistics about the users of the facilities (such as for examples the users’ domains and browser types). None of this information specifically identifies an individual and it is used solely to ensure that Connect website and applications present the best possible navigational experience for users.

If you have registered an account with a company belonging to the Connect group of companies (such as Connect Solutions AG or Connect4Success AG), you will be identified by a user name and password when you log into our website or applications. The information we collect about members’ use of our websites may be used for measuring use and performance and in assisting to resolve any technical difficulties.

As the Connect group companies want the user experience to be informative and resourceful as possible, a number of links to websites operated by third parties may be provided that may also set cookies. Please note that we assume no responsibility for the information practices of these third party websites that you may be able to access through ours. When a visitor to our website links to these third party websites, our privacy practices no longer apply.

Security and Protection of Personal Data

Connect will endeavour to take all reasonable steps to keep secure, accurate and up to date any information that we hold about you in whatever form (electronically or in hard-copy) and to implement generally accepted standards of technology and operational security to protect the personal data either being in its possession or under its control to prevent unauthorised access, disclosure, use, disposal or similar risks. Connect requires its employees and data processors to respect the confidentiality of any personal information held by Connect.

Access to and Correction of Personal Data

Upon request, the individual will be provided with access to his/her personal data or other appropriate information on his/her personal data in accordance with the respective FADP requirements.

Furthermore, Connect will upon request, we correct any error or omission in the individual’s personal data being in its possession or control in accordance with the respective FADP requirements.

Accuracy of Personal Data

We will make a reasonable effort to ensure that personal data collected by us or on our behalf is accurate and complete.

Retention of Personal Data

We will cease to retain personal data, as soon as it is reasonable to assume that the purpose for collection of such personal data is no longer being served by such retention, and such retention is no longer necessary for legal or business purposes.

Withdrawal of Consent and Opting Out

You may withdraw your consent to the collection , storage and use of your personal data (always provided that Connect is not required by applicable laws or regulations to keep the data or where such data are necessary to fulfill its contractual obligations ) at any time with future effect by writing a letter to
